Non-DOT Regulated Employees: These employees (office staff, warehouse employees, non-CDL drivers) are not required to follow federal DOT testing rules. If you employ CDL drivers in Oregon, you are required to follow federal DOT drug and alcohol testing rules under 49 CFR Parts 40 and 382. These regulations apply to all safety-sensitive roles, and missing a requirement can lead to audits, fines, or drivers being removed from duty.

To stay compliant, you are required to: complete pre-employment, random, post-incident, reasonable suspicion, return-to-duty, and follow-up testing; use HHS-certified laboratories; have results reviewed by a licensed MRO; and maintain accurate records for inspections and FMCSA audits. How much does a DOT Consortium membership cost in Oregon?

Owner-operators or small fleets with fewer than five drivers: $100 per driver annually

Larger companies: $195 per company per year plus $45 per driver, covering random testing and documentation

Non-random tests: $65 per drug test and $55 per alcohol test, billed per event

Your annual membership includes all required random drug and alcohol tests. There are no per-random testing fees.

How often are random drug tests conducted?

Under 49 CFR 382.305(k), random tests must be unannounced and dates spread reasonably throughout the calendar year. DOT guidance recommends conducting selections at least quarterly, and AZC runs selections quarterly for that reason. Drivers are chosen using a scientifically valid random selection method, so every driver in the pool has an equal chance each time.

What happens if an employee fails a drug or alcohol test?

The employee must be removed from safety-sensitive duties immediately, and we will coordinate the Substance Abuse Professional process and any required steps before they can return to work.

Who is required to join a DOT consortium?

Owner-operators running under their own authority must join a consortium, because a one-person pool cannot produce statistically valid random selections. Small employers typically join one for the same reason. Larger fleets may either join a consortium or operate their own standalone random testing program if they have enough covered employees and the administrative capacity to manage it. Every employer with CDL drivers in safety-sensitive roles must maintain a compliant testing program either way.
