California Drug Testing: DOT vs. Non-DOT Mandates
Different employees must follow different testing rules. Here’s a quick breakdown to help you understand who falls under federal DOT requirements and who does not:
- DOT-Regulated Employees: These are your safety-sensitive workers regulated by agencies such as FMCSA, FAA, FRA, PHMSA, or FTA. In California, this includes CDL drivers who:
- Operate vehicles with a GVWR of 26,001 pounds or more
- Operate vehicles with a Combined GVWR of 26,001 or more, inclusive of towed unit(s) with a GVWR of 10,000 pounds or more
- Operate vehicles designed to transport 16 or more passengers, including the driver
- Transport hazardous materials in a quantity that requires placarding
They must complete federally required drug and alcohol testing, including pre-employment, random, post-accident, reasonable suspicion, return-to-duty, and follow-up testing.
