Are You Required to Test?
The parties that are required to test under FAA rules are outlined in the 14 Code of Federal Regulations (CFR), Part 120.1. All employers and employees are required to test if they perform safety-sensitive duties, such as the following:
-
Any certified or non-certified contractor (individual or entity) that performs safety-sensitive duties
-
All 14 CFR Part 145 certificate holders who perform safety-sensitive functions
-
All operators (air tour operators) as defined by 14 CFR § 91.147
-
All air traffic control facilities not operated by the FAA or by or under contract to the U.S. military
-
All certificate holders (air carriers and operators) under 14 CFR Part 119 that are authorized to operate under 14 CFR Part 121 or Part 135
-
All Part 145 repair facilities that perform safety-sensitive functions
It isn’t always easy to determine if a particular facility or employee falls under these regulations, as the rules are quite complex. When you partner with AZC Drug Testing, you can put our in-depth expertise to work for you. We’ll thoroughly review your company and employees to determine which of them is considered to perform safety-sensitive functions.
